1. Acceptance of Terms

By accessing, browsing, registering on, or using the VahanSpace platform ("Platform"), you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies published on the Platform from time to time.

If you do not agree with these Terms, you must not access or use the Platform.

2. Nature of Services

VahanSpace is a technology platform that facilitates connections between vehicle buyers, sellers, dealers, service providers, inspection agencies, insurance providers, financial institutions, and other automotive ecosystem participants.

VahanSpace is solely an intermediary platform and:

• Does not own, buy, sell, lease, or transfer vehicles.
• Is not a party to any transaction between users.
• Does not guarantee the condition, ownership, legality, quality, safety, mileage, history, documentation, or suitability of any vehicle.
• Does not provide legal, financial, insurance, or tax advice.

All transactions are conducted solely between the participating parties.

3. User Eligibility

Users must:

• Be at least 18 years of age.
• Have the legal capacity to enter into binding agreements.
• Provide accurate, complete, and current information.

VahanSpace reserves the right to suspend or terminate accounts providing false or misleading information.

4. User Responsibilities

Users are solely responsible for:

• Verifying vehicle ownership.
• Verifying Registration Certificate (RC).
• Verifying insurance validity.
• Verifying tax compliance.
• Verifying vehicle history.
• Conducting physical inspections.
• Verifying seller credentials.
• Reviewing financing and insurance terms.
• Ensuring compliance with applicable laws.

Users must perform their own due diligence before entering into any transaction.

5. Vehicle Listings

Vehicle listings are created by sellers, dealers, or authorized representatives.

VahanSpace does not independently verify:

• Vehicle specifications.
• Ownership claims.
• Accident history.
• Odometer readings.
• Service records.
• Pricing accuracy.
• Availability status.

Listing information may contain inaccuracies and should not be solely relied upon.

6. Dealer and Seller Representations

Dealers and sellers represent and warrant that:

• They have lawful authority to list the vehicle.
• Information provided is accurate and not misleading.
• The vehicle is not stolen, encumbered, or involved in unlawful activities unless expressly disclosed.
• They possess all necessary rights to sell or advertise the vehicle.

Any violation may result in account suspension, listing removal, and reporting to authorities.

7. Inspection Services

Inspection reports provided through the Platform are based on observations made at the time of inspection.

VahanSpace:

• Does not guarantee inspection outcomes.
• Does not warrant future vehicle performance.
• Is not liable for undiscovered defects.

Inspection reports are informational only.

8. Insurance and Finance Services

Insurance, financing, and loan services may be offered by third-party partners.

VahanSpace:

• Is not an insurer.
• Is not a lender.
• Does not guarantee approval of loans or insurance.
• Is not responsible for partner decisions, rates, premiums, terms, or conditions.

Users should independently review all partner agreements.

9. Payments

Where payment services are integrated:

• Payment processing is handled by authorized third-party payment providers.
• VahanSpace is not responsible for payment failures, delays, chargebacks, or banking errors.

Any disputes regarding payments must be resolved directly with the relevant parties.

10. Prohibited Activities

Users shall not:

• Post false information.
• Misrepresent ownership.
• Upload fraudulent documents.
• Engage in deceptive advertising.
• Conduct unlawful activities.
• Post inappropriate content.
• Violate intellectual property rights.
• Attempt unauthorized access to the Platform.

VahanSpace reserves the right to suspend accounts without prior notice.

11. Intellectual Property

All trademarks, logos, software, content, design elements, and branding associated with VahanSpace remain the exclusive property of VahanSpace.

Users may not copy, distribute, modify, or reproduce Platform content without prior written consent.

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis.

VahanSpace makes no representations or warranties regarding:

• Vehicle quality.
• Vehicle condition.
• Vehicle ownership.
• Vehicle fitness for purpose.
• Accuracy of listings.
• Availability of services.
• Uninterrupted platform access.

Use of the Platform is entirely at the user's own risk.

13. Limitation of Liability

To the maximum extent permitted by law, VahanSpace, its directors, employees, affiliates, partners, agents, and service providers shall not be liable for:

• Direct losses.
• Indirect losses.
• Consequential damages.
• Loss of profits.
• Loss of data.
• Vehicle defects.
• Fraud by users.
• Misrepresentation by dealers or sellers.
• Failed transactions.
• Financing disputes.
• Insurance disputes.
• Inspection-related claims.

The total liability of VahanSpace, if any, shall not exceed the fees actually paid by the user to VahanSpace during the preceding one month.

14. Indemnification

Users agree to indemnify and hold harmless VahanSpace, its directors, officers, employees, affiliates, and partners against any claims, liabilities, losses, damages, penalties, costs, or legal expenses arising from:

• User actions.
• Breach of these Terms.
• Fraudulent activities.
• Regulatory violations.
• Disputes with third parties.

15. Fraud Prevention

VahanSpace reserves the right to:

• Verify user identity.
• Request additional documentation.
• Suspend suspicious accounts.
• Remove listings.
• Cooperate with law enforcement agencies.

16. Third-Party Services

The Platform may contain links to third-party websites, products, and services.

VahanSpace is not responsible for:

• Third-party content.
• Third-party practices.
• Third-party transactions.

Users access such services at their own risk.

17. Privacy

Collection and use of personal information shall be governed by the Privacy Policy published on the Platform.

18. Suspension and Termination

VahanSpace may suspend or terminate access to the Platform at its sole discretion for:

• Violation of these Terms.
• Fraudulent activities.
• Security concerns.
• Regulatory requirements.

19. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

20. Changes to Terms

VahanSpace reserves the right to modify these Terms at any time.

Continued use of the Platform after such modifications constitutes acceptance of the revised Terms.
